TERMS AND CONDITIONS OF HIRE
The following conditions are applied to the hirer from Lightning Media Ltd, Unit 32 Wadsworth Road Perivale UB6 7JB.
The Hirer agrees to the following:
1) The equipment on hire belongs to the above company, unless the invoice states the goods are purchased in
which case they belong to us untill payment has been received by us in full.
2) The customer shall take good care of the equipment and ensure it is used in a proper manner by persons having the necessary experience and training. No attempt should be made to adjust ,interfere with or repair the equipment, A charge will be added to your hire in the event of such evidence found on the equipment upon its return and may also include a charge for the recalibrition of the equipment.
3) The hirer holds full responsibility for the equipment and no responsibility can be passed on to other parties.
4) Account holders will pay the company for the hired period, or the purchase value within 30 days of invoice, unless otherwise stated by the company on the invoice, a late payment charge of 10% will be added if payment is recieved after 30 days.
5) Non-Account holders are required to leave a deposit where necessary and are to pay for the hire period in full on collection of the equipment.
6) The hirer will pay the company an extra charge for each day the equipment is retained after the agreed date, which will not end until the equipment has been returned back to the company.
7) The hirer will notify the company if the equipment needs to be kept for a longer period than originaly agreed to obtain approval either by email or fax.
8) The hirer will notify the company immediately if any damage is caused upon the equipment.
9) The hire period will not be terminated until the equipment is returned to our company permises, at the hirer’s expence, unless a collection charge has been arranged by the company.
10) Fair wear and tear is accepted, provided that if the equipment is lost, damaged or destroyed the hirer will pay the company the extra hire charges, until the equipment is replaced, repaired or recovered (where appropiate) and delivered to the company premises by the hirer.
11) The equipment is supplied to the hirer at the hirer’s risk in all respects.
12) The hirer will inform the company director of any actions being taken against the company, the director or any employee/s (actions such as injury claims).
13) The company director holds the right to enter upon any permises on which equipment is believed to be kept, for the purpose of recovery of equipment at the end of the termination date, the hirer shall compensate the company for any cost of having to recover equipment in this way including lost revenue.
14) The conditions are taken as accepted,on collection from or delivery by Lightning Media Ltd.
15) Any equipment left within the company, either on hold or for repairs not collected within three months will be disposed.
16) The company supplies equipment materials and special services in circumtances where it is customary for such essentials to be supplied at the customers risk and where the customer is required to provide insurance.
17) By the customer placing an order via phone , fax or email the customer constitutes a business transaction, thus creating an agreement into which both parties are freely entering.
18) Any advise issued, instruction, guidance or statement inconnection with or relation to the use and application of any equipment/materials or services supplied by the company or directoring staff,technical staff or customary agents,is given only on the condition that the company shall in no circumstances be liable for any loss or damage of any kind.
19) The agreement between Lightning Media Ltd and customer rely solely on the terms of these conditions and representation or otherwise shall bind the company and no statement from any representative of the company shall vary these conditions unless a representative statement shall be made in writing signed by the director of the company.
20) To repair and maintain the equipment in good working order without charge to the hirer provided that such maintenance has not occurred by misuse or damage whether accidental or otherwise.
21) To supply the hirer with replacement equipment if at any time during the hire period the equipment cannot be effectively repaired or maintained as a result of any mechanical or electrical fault. The companies liability in this respect shall be subject to avaliablity of replacement of such equipment. For replacement equipment due to the above reason a fax has to be received before the equipment can be released. Goods will be delivered to the orginial address at time of booking.
22) Insurance cover, The customer undertakes full responsibilty for insuring all equipment against “all risks” to full replacement value. Any loss or damage to the equipment is to be reimbursed to the company by the customer to the full replacement value thereof.If the customer has their own insurance cover , a copy of this is required before collecting equipment from us and MUST show HIRED IN GOODS VALUE in your cover and 13 weeks loss of hire at full rate or untill the equipment is replaced by the insurance company.
23) It is important that all customers and their insurers read Lightning Media Ltd terms and conditions , as awarness of liabilities of the company or idemnity for the customer may apply.
24) No liability is accepted , consequential or otherwise , by act or ommition by Lightning Media Ltd whether by negligence,delay,detention,late delivery, non delivery, or deficiency in the equipment or order.
25) A cancellation charge of one full weeks hire shall be payable to Lightning Media Ltd at less than four weeks notice of cancellation , or if less than one weeks notice 50% of total invoice value.
26) Provisinal/Pencil bookings are taken on the understanding that they do not guarantee the availability of the equipment.
27) All lighting issued by us is supplied with a spare bulb and a working bulb already fitted in the lamp. Should either of these be returned blown, you will be charged for it at the prevailing rate.
28) Missing, damaged/Non-Returned – If any of the kit supplied by us is returned damaged or with missing items, you will be notified by e-mail, after 7 days we will invoice for replacements.
